Waste — obligations and checks (Italy)

A list of checks and obligations with their cadence, ready to add to your agenda.

Italian kit for companies and public bodies producing special waste. Covers RENTRI registration and its annual fee, the chronological load and unload register, transport forms, the MUD return, temporary storage limits, waste classification and analyses, verification of hauliers' and destination plants' permits, and the National Register of Environmental Operators. It also covers the end of life of AED batteries and pads and of withdrawn fire extinguishers. It does NOT cover the municipal waste tax, household waste, membership of EPR consortium schemes (WEEE, packaging, batteries) or treatment-plant permitting.

Dispose of AED batteries and pads at end of life

The event that triggers this control is the replacement of a defibrillator's consumables: a flat or expired battery and used pads leave the device and from that moment are waste. Spent batteries and accumulators are classified as hazardous waste and must be collected separately through the dedicated take-back schemes, never with mixed waste. Whoever holds the AED — company, sports club, building administrator — sees to it, handing them to the distributor, the collection centre or an authorised operator; used pads follow the channel the manufacturer indicates or the healthcare-waste route.

Pay the annual environmental operators register fee by 30 April

Companies entered in the National Register of Environmental Operators pay the annual registration fee by 30 April each year, in an amount set by category and class; non-payment suspends the entry. The evidence is the payment receipt. Applies only to companies and bodies entered in the register, with an annual registration fee of EUR 50 for category 2-bis alone under art. 212(8)(d) of D.Lgs. 152/2006; amount and deadline should be confirmed on the register's portal.

Pay the annual RENTRI fee by 30 April

From the second year onward the registered party pays the annual RENTRI registration fee for each local unit by 30 April, exclusively through PagoPA on the portal; non-payment suspends the digital register. The evidence is the PagoPA receipt. Applies to all RENTRI registrants from the year after registration, with indicative amounts of EUR 60 per local unit for professional operators, EUR 30 for producers with 11-50 employees and EUR 10 for other producers.

Verify hauliers' and destination plants' permits

Before each shipment and periodically, check that the haulier is entered in the National Register of Environmental Operators for the right category and EWC codes and that the destination plant is authorised to receive that waste with the specific R or D operation, since the producer's liability is discharged only if the whole chain is compliant. The evidence is a copy of the current registration and permit documents. Applies to all producers who hand their waste to third parties: registrations and permits can be suspended or revoked without notice, so the expiry date shown on the documents must also be checked.

Send withdrawn fire extinguishers for disposal

The event that triggers this control is the withdrawal of an extinguisher: failed at its pressure test, expired or simply replaced, from that moment it is special waste and cannot end up in a skip, in scrap metal or forgotten in a store room. Collection must be entrusted to a company entered in the National Register of Environmental Operators and accompanied by the waste identification form, whose returned copy proves the load reached its destination. Classification under the correct EWC code depends on the extinguishing agent and on the presence of hazardous substances and is agreed with the operator: there is no single code valid for every extinguisher.

File the MUD return by 30 April

The single environmental declaration reports to the Chamber of Commerce the quantities of waste produced, transported, recovered or disposed of in the previous calendar year and is filed electronically with a digital signature through the Ecocamere services; when the annual decree is published after 1 March the deadline shifts to 120 days from publication, as happened for the 2026 return, moved to 3 July 2026. The evidence is the electronic submission receipt. Applies to initial producers of hazardous waste, to producers of special non-hazardous waste from industrial and craft activities with more than ten employees, to anyone professionally collecting, transporting, recovering, disposing of, trading or brokering waste, and to municipalities and municipal waste service operators.

    Check the temporary storage limits

Check that waste grouped at the place of production meets one of the two alternative criteria of art. 185-bis: removal for recovery or disposal at least every three months regardless of quantity, or removal once the volume limits of 30 cubic metres — of which at most 10 of hazardous waste — are reached and in any case within one year; exceeding the limits turns temporary storage into unauthorised storage. The evidence is the chronological register together with the transport forms documenting the periodic removals. Applies to all producers grouping waste before handover: the two criteria are alternatives and the choice must be made for each waste stream, with storage by homogeneous categories and, for hazardous waste, in compliance with the labelling rules for dangerous substances.

Issue and file a waste transport form for every shipment

Every off-site waste shipment travels with the identification form issued by the producer and digitally validated through RENTRI; the fourth copy or the digital confirmation must return to the producer within three months of delivery and, failing that, the producer notifies the Province. The evidence is the copy of the form countersigned by the destination plant. Applies to every shipment of special waste made by or on behalf of the producer, with the exemption of art. 193(7) reserved for occasional and infrequent transport — no more than five times a year — not exceeding thirty kilograms or thirty litres a day: both conditions must be met together.

Update the waste classification and analyses

Assign the correct EWC code to each waste stream and, for mirror entries or whenever the composition is not reliably known, have a laboratory run the analyses needed to establish the HP1-HP15 hazard properties; the classification must be redone whenever the process, the raw material or the supplier changes. The evidence is the classification report signed by a technician together with the laboratory test reports. Applies to all producers: analyses are needed in particular for mirror entries, for waste destined to plants that require them for acceptance, and for remediation or demolition waste.

Register with RENTRI and keep the master data aligned

Producers, hauliers, operators and brokers register on the national electronic waste traceability register at rentri.gov.it with the legal representative's digital signature, listing their local units; registration triggers the duty to keep the chronological register digitally and must then be reviewed yearly for local units, EWC codes, contacts and the expiry of the digital signature. The evidence is the registration receipt with the identifier issued by the portal. Applies according to registration windows: 15/12/2024-13/02/2025 for treatment plants, hauliers, traders, brokers, consortia, hazardous-waste producers and industrial or craft producers of non-hazardous waste with more than 50 employees; 15/06/2025-14/08/2025 for the same parties with 11-50 employees; 15/12/2025-13/02/2026 for hazardous-waste producers with up to 10 employees and for non-business producers.

Apply to renew the entry in the environmental operators register

Anyone transporting waste, including their own, must be entered in the National Register of Environmental Operators: the entry lasts five years, ten for category 2-bis covering own-waste transport, and the renewal application is filed with the competent regional section from five months before expiry. The evidence is the renewal decision together with the electronic filing receipt. Applies only to companies and bodies that actually transport waste — category 2-bis for their own non-hazardous waste and for their own hazardous waste up to 30 kg or 30 litres a day, categories 1, 4 and 5 for third-party transport — and not to those who simply have a registered haulier collect their waste.

Record waste in the chronological load and unload register

The producer records every movement in the chronological register within ten working days of producing the waste and of its removal, while recovery and disposal plants do so within two days of taking charge; from the RENTRI registration date the register is kept and validated digitally on the portal or through interoperable software. The evidence is the register itself, tamper-proof and downloadable as a signed PDF, to be kept for three years from the last entry. Applies to all hazardous-waste producers and to producers of special non-hazardous waste from industrial and craft activities; art. 190(5) exempts farmers with annual turnover up to EUR 8,000, companies transporting their own non-hazardous waste under art. 212(8) and, for non-hazardous waste only, initial producers with no more than ten employees.
