Landlord gas safety check and CP12 (United Kingdom)

For landlords of residential property and those managing it — letting agents, property managers, housing associations — and for employers with gas appliances in premises under their control. It covers the gas safety check due within twelve months on appliances, pipework and flues, giving the Gas Safety Record (the document everyone calls the CP12) to the tenant, keeping the records, the Gas Safe Register requirement for anyone working on gas, the warranty service and refrigerant recovery when an appliance is decommissioned. It does not cover industrial gas installations under their own regimes, nor carbon monoxide alarms, which have separate rules.

Gas safety check within twelve months
The landlord must have every gas appliance and every flue checked within twelve months of installation and thereafter at intervals of no more than twelve months since the last check. Only an engineer on the Gas Safe Register may carry the check out and issue the Gas Safety Record. The duty covers rented residential property, HMOs included, and does not extend to the tenant's own appliances, while the flue duty stays with the landlord where the flue is theirs. Breach is a criminal offence.

Use a Gas Safe registered engineer for gas work
Anyone working on gas fittings, pipework or appliances must be competent and on the Gas Safe Register: the duty binds the business carrying out the work, and for the person commissioning it the practical form is checking the ID card before the job starts — number, expiry and the categories the engineer is qualified for. The yearly review exists to re-check the registrations of regular contractors, which expire. Regulation 3 is cited as the reference: unlike regulation 36 its text was not read on a primary source, so no source link is given here.

Decommissioning boilers and heat pumps
What triggers this control is the removal or replacement of the appliance. Where it contains fluorinated gases — typically a heat pump — the refrigerant must be recovered before disposal by personnel holding the required qualification, and venting to atmosphere is prohibited. The metal body goes to scrap while boards and controls follow the WEEE route: the duty sits with the operator holding the appliance, who should keep the recovery record issued by the technician.

Give the Gas Safety Record within 28 days
A copy of the Gas Safety Record must be given to existing tenants within twenty-eight days of the date of the check, and to new tenants before they take up occupation. The duty is the landlord’s: it can be carried out through a letting agent, but the responsibility cannot be delegated away. Keeping evidence of delivery — email, receipt, signature — is what makes the duty demonstrable if the local authority asks, since a check carried out but never handed over is still a breach.

Annual boiler service to keep the warranty
For an owner-occupier the annual boiler service is not a legal obligation: it is the contractual condition on which manufacturers — Worcester Bosch, Vaillant, Baxi, Ideal, Viessmann — keep the warranty alive, and each words it differently. It should be carried out by a Gas Safe registered engineer and recorded in a service report, because that is what the manufacturer asks for when something fails. Landlords have the separate statutory duty of the annual safety check, which is a different thing and does not replace the service.

Keep the Gas Safety Records
The landlord must keep each Gas Safety Record until two further checks have been carried out on the same appliance, and for at least two years for appliances that have been removed. This is a paperwork duty rather than a technical one: anyone managing several properties handles it by keeping a per-property archive, so the record asked for can be produced without reconstructing it. The yearly review suggested here exists to confirm the archive is complete before the next check falls due.
