For Spanish businesses and professionals that produce waste, place packaging on the market or dispose of WEEE. Covers registration, the chronological waste file, the annual hazardous-waste report, storage limits, shipments (DI/NT), packaging and WEEE under Ley 7/2022 and related decrees. Does not cover waste-manager authorisations, contaminated soils, by-products or the procedures specific to each Comunidad Autónoma.

Submit the annual waste summary report
By 1 March each year the hazardous-waste producer, and the authorised waste manager, sends the Comunidad Autónoma a summary of the previous year's chronological-file data, with the minimum content of Anexo XV. Proof: the electronic submission receipt. Applies to hazardous-waste producers, authorised managers, professional carriers of hazardous waste, dealers and brokers; those who file all identification documents through eSIR may be exempted in some Comunidades Autónomas.

Remove waste within the maximum storage times
Hazardous waste may not remain at the production site for more than 6 months; non-hazardous waste destined for disposal for more than 1 year, and waste destined for recovery for more than 2 years. Schedule collection by an authorised manager before the limit is reached. Proof: the shipment identification document (DI). Applies to all waste producers: the count starts on the date storage began and the Comunidad Autónoma may grant justified extensions.

Hand professional WEEE to an authorised manager
Non-household users remain responsible for electrical and electronic equipment until it is handed to a collection point or to an authorised manager, who issues the delivery documentation. Proof: the manager's delivery certificate and the shipment DI. Applies to businesses and public bodies disposing of professional EEE or of household EEE used professionally; distributors with an EEE sales area of at least 400 m² must also take back very small WEEE free of charge and with no obligation to buy.

Run the packaging prevention and eco-design plan
Product producers that exceed the packaging thresholds run a five-year prevention and eco-design plan, individually or through a collective scheme (SCRAP). Within three months of the plan's end, a report on target achievement is sent to the Comunidad Autónoma of the registered office. Proof: the plan and the filed final report. Applies once the annual thresholds are exceeded: 250 t glass, 50 t steel, 30 t aluminium, 20 t plastic, 20 t wood, 15 t cardboard or composite materials, 300 t where several materials are used and none exceeds its own threshold.

File the prior notification and register as a waste producer
Before starting operations, a producer of hazardous waste, or of more than 1,000 t/year of non-hazardous waste, files the comunicación previa with the Comunidad Autónoma, which enters it in the Registro de producción y gestión de residuos. The notification must be updated whenever the activity changes substantially. Proof: the notification receipt and the registration or NIMA number. Applies to producers of hazardous waste and to producers of more than 1,000 t/year of non-hazardous waste; the form and the portal vary by Comunidad Autónoma.

Issue the DI and prior notification for each shipment
For every waste shipment inside Spain the operator completes the identification document (DI) before the shipment starts. Hazardous waste, and some non-hazardous waste destined for disposal or for certain recovery operations, also needs a prior notification (NT) filed at least 10 days in advance. Proof: the DI signed by all parties and the accepted NT. Applies to the shipment operator, normally the producer or the receiving manager; the NT is required for hazardous waste and for non-hazardous waste destined for disposal or for the recovery operations listed in art. 3.2.

Handle materials removed on site as C&D waste
Fire doors, shutters, window frames and metal components stripped out during refurbishment are not waste from the business: they are construction and demolition waste, and RD 105/2008 assigns them to the producer of the works, who has to hand them to an authorised manager and keep the delivery note. In practice the duty moves to the company doing the work, but the client is still the one asked for the document. This kit cites the rule without going into the detail of separating the fractions: that point has not been verified article by article and should be read in the text before it is applied literally.

Route spent batteries and accumulators to their stream
Spent portable batteries, industrial batteries and starter accumulators do not follow the fate of ordinary waste: the Spanish rules on batteries and accumulators require separate collection and handover through collection points and extended producer responsibility schemes. This is a standing duty of anyone holding them rather than a deadline: it fires at every replacement, and whoever supplies the new ones is normally required to take the old ones back. Proof: the delivery note. The annual review is there to check the places where batteries pile up with nobody taking them away.

Report equipment placed on the market to the RII-AEE
An EEE producer registered in the RII-AEE section of the Registro Integrado Industrial reports quarterly and electronically the units and weight of equipment placed on the Spanish market, by category. Proof: the electronic receipt of the report. Applies to EEE producers, that is manufacturers, importers and distance sellers placing equipment on the Spanish market, and not to mere users.

Declare packaging placed on the market
A product producer registered in the packaging section of the Registro de Productores de Productos reports by 31 March the quantities of packaging placed on the Spanish market in the previous year, by material and category. Proof: the submission receipt of the annual declaration. Applies to all product producers placing packaging on the Spanish market, including foreign distance sellers acting through an authorised representative.

Keep the chronological waste file up to date
Record chronologically the quantity, nature, LER code, origin, destination and treatment of every waste stream produced or handled, together with the shipment data. The file must be updated at every movement and kept for at least five years. Proof: the file itself, electronic is fine, with the linked identification documents. Applies to hazardous-waste producers and to producers of more than 10 t/year of non-hazardous waste, as well as to waste managers, professional carriers, dealers and brokers.
